Action under the safe-place statute commenced by plaintiff Lorraine Schwenn against defendants Loraine Hotel Company and Yellow Cab and Transfer Company, for personal injuries suffered when she fell in the driveway in front of the Loraine Hotel where Yellow Cab maintained a taxi stand. Howard Schwenn, husband of Lorraine, also brought action against the same defendants to recover for his wifes medical expenses and for the loss of her society, services and companionship. Trial by jury was had and a special verdict returned finding (1) that the place where the plaintiff fell constituted a place of employment of the hotel and the cab company, (2) that each of the defendants failed to have the driveway as free from danger to frequenters as the nature of the employment and of the driveway would reasonably permit, (3) that both defendants had notice of the unsafe condition, (4) that there was a causal connection between the failure of the defendants and the plaintiffs injuries, (5) that plaintiff failed to exercise reasonable care for her own safety, and apportioning the negligence 33 1/3 per cent to the plaintiff Lorraine Schween and 66 2/3 per cent to the defendants as a unit. From judgments on the verdict, defendants appeal.
