Two actions in the Hennepin County District Court arising out of a collision between a car driven by Earl N. Kleist and one
driven by Jacob L. Weinberg. One action was brought against Kleist by Loretta Ballweber, a passenger in the Weinberg car,
for personal injuries. In that action Weinberg was joined as third-party defendant. The second action was brought by said
Weinberg against Kleist for personal injuries and property damage. The cases were tried together before D. E. LaBelle, Judge,
and a jury, which returned a verdict for plaintiff in the first action for $19,000 and for defendant in the second action.
Jacob L. Weinberg appealed (No. 37,031) from the judgment entered pursuant to the verdict in the first action; and (No. 36,800)
from an order in the second action denying his alternative motion for a new trial on the issue of damages only or for a new
